Fine v Sheriff (09-A827) Mr Danny Bickell and filing at the US Supreme Court

1) Around April 12, 2010, I, Joseph Zernik,  first spoke with Mr Danny Bickell, staff member of the US Supreme Court Clerk's Office.  At that time I informed him that I intended to file a Motion to Intervene in Fine v Sheriff (09-A827), which was scheduled for conference on April 23, 2010.  His response was that filing papers in the case was timely as long as the Application was pending before the court.  He added that unless a Motion to Intervene provided a "compelling justification" for the intervention, it was likely to be denied by the court. 

2) I informed Mr Bickell that I was going to mail it priority mail, and he made no comment on that.

3) On April 15, 2010, I mailed the papers, priority mail, certified.

4) On April 16, 2010 I called the court and spoke with staff member at the clerk's office, who identified herself as "Molly", in an effort to ascertain that the papers were received. Molly informed me that the papers were unlikely to reach the clerk's office by April 23, 2010, because of anthrax checks on all incoming mail.

5) On April 20, 2010, I flew to Washington DC and hand delivered the papers at the Supreme Court security station, where receipt stickers were issued.  I was informed that the papers would be at the hands of the clerk's office staff by the next morning, or the latest by the next afternoon.

6) On April 21, 2010 I called and spoke with US Supreme Court clerk's office case analyst Mr Erik Fossum. He informed me that my papers were indeed received, and that they were held by Mr Danny Bickell.

7) I was then forwarded to Mr Danny Bickell.  He initially tried to tell me that the papers had not been received by the clerk's office, due to security checks.  Only after I informed him that Mr Fossum had already informed me that Mr Bickell was holding the papers, Mr Bickell admitted that such was indeed the case. 

8) Mr Bickell then proceeded to tell me that he had not yet decided regarding the disposition of the papers. Mr Bickell never stated any discrepancy in the papers.

9) I asked if he was authorized as a Deputy Clerk. He informed me that he was not. Regardless, he insisted that he was authorized to either docket the papers, or not docket the papers without even a discrepancy notation in the docket, indicating that paper were filed, then rejected.

10) I then asked him for the basis for his March 12, 2010 notice to the parties in Fine v Sheriff (09-A827) of denial by Justice Kennedy. The Rules of the Supreme Court were explicit, that the justice would note the denial on the petition. However, a March 22, 2010 copy of the petition from US Supreme Court file had no such notation on it.  Neither was any ruling or order of denial listed in the log of orders of the court on or about March 12, 2010.  Mr Bickell responded that he was not required to answer such questions.

11) The papers, which Mr Danny Bickell was holding, provided incontrovertible documentary evidence, which Richard Fine himself had no access to, which showed that Richard Fine was held under alleged fraud in records of the Sheriff and the Los Angeles Superior Court, and that there was never any valid and effectual warrant, judgment, conviction, or sentencing entered in his case.

12) In short - Mr Bickell was and is denying access to the US Supreme Court, in a manner that a reasonable person would conclude was likely to pervert justice in the case at hand.

8) El Sr. Bickell luego procedió a decirme que todavía no había decidido respecto a la disposición de los documentos. Sr. Bickell nunca declaró que exista alguna discrepancia en los periódicos.
9) Le pregunté si estaba autorizado como Secretario Adjunto. Él me informó que él no lo era.De todos modos, insistió en que él estaba autorizado a cualquiera de expediente los documentos, o no expediente los documentos sin siquiera una notación discrepancia en el expediente, lo que indica que el papel se presentaron, luego rechazó.

11) Los documentos, que el señor Danny Bickell sostenía, aportó pruebas documentales incontrovertibles, que el propio Richard Fine no tenían acceso a, que demostró que Richard Fine se celebró bajo un supuesto fraude en los registros del Sheriff y de la Corte Superior de Los Angeles, y que nunca hubo una orden válida y eficaz, juicio, condena, o condena, entró en su caso. [1]
12) En resumen - Señor Bickell era y es negar el acceso a la Corte Suprema de los EE.UU., de manera que una persona razonable concluiría era probable que pervierten la justicia en el caso que nos ocupa.

1) um 12 April 2010, I, Joseph Zernik, sprach zuerst mit Herrn Danny Bickell, Mitarbeiter des US Supreme Court Clerk's Office. Zu dieser Zeit teilte ich ihm mit, dass ich bestimmt ein Motion-Datei zu intervenieren, feine V Sheriff (09-A827), die für die Konferenz am 23. April 2010 geplant war. Seine Antwort war, dass die Einreichung Papiere im Fall rechtzeitig war, solange der Antrag vor dem Gerichtshof anhängig. Er fügte hinzu, es sei denn, ein Antrag auf Einschreiten einen "zwingenden Grund" für die Intervention vorgesehen, wurde es wahrscheinlich durch das Gericht verweigert werden.

4) Am 16. April 2010 rief ich den Hof und sprach mit Mitarbeiter der Geschäftsstelle, die sich als identifiziert "Molly", in dem Bemühen um festzustellen, dass die Papiere empfangen wurden.Molly teilte mir mit, dass die Papiere unwahrscheinlich, dass die Geschäftsstelle von 23. April 2010 erreicht wurden, weil der Milzbrand-Kontrollen bei allen eingehenden Mails.
5) Am 20. April 2010, flog ich nach Washington DC und Hand hielt die Papiere am Obersten Gerichtshof der Sicherheit Station, wo Eingang Aufklebern ausgestellt wurden. Ich wurde darüber informiert, dass die Papiere würden in den Händen der Geschäftsstelle Mitarbeiter am nächsten Morgen, oder spätestens am nächsten Nachmittag.
6) Am 21. April 2010 rief ich und sprach mit dem US-Supreme Court Geschäftsstelle Fall Analyst Herr Erik Fossum. Er informierte mich, dass meine Papiere waren in der Tat erhalten, und dass sie von Herrn Danny Bickell abgehalten wurden.
7) Ich war damals von Herrn Danny Bickell weitergeleitet. Er versuchte zunächst, mir zu sagen, daß die Papiere nicht von der Geschäftsstelle eingegangen ist, durch Sicherheitskontrollen.Erst nachdem ich ihm mitgeteilt, dass Herr Fossum haben mich schon informiert, dass Herr Bickell hielt die Papiere, gestand Herr Bickell, dass diese tatsächlich der Fall war.
8) Herr Bickell fuhr dann fort, mir zu sagen, dass er noch nicht über die Anordnung der Papiere entschieden. Herr Bickell nie erklärt, eine Diskrepanz in der Zeitung.
9) Ich fragte, ob er als Deputy Clerk zugelassen wurde. Er teilte mir mit, daß er nicht.Unabhängig davon, bestand er darauf, dass er entweder docket war der Papiere, oder nicht docket die Papiere, ohne auch nur eine Diskrepanz in der Notation docket, darauf hinweist, dass Papier zugelassen wurden eingereicht, dann abgelehnt.
10) Ich fragte ihn dann zur Grundlage für seine 12. März 2010 Mitteilung an die Parteien in feiner V Sheriff (09-A827) des Leugnens von Justice Kennedy. Die Geschäftsordnung des Obersten Gerichts wurden explizit, dass der Gerechtigkeit würde die Verweigerung der Petition zur Kenntnis. Allerdings hatte ein 22 März 2010 Kopie der Petition aus der US-Supreme Court-Datei keine solche Notation auf sie. Auch wurde kein Urteil oder Beschluss vom Leugnen im Protokoll der Beschlüsse des Gerichts am oder um den 12. März 2010 aufgeführt. Herr Bickell antwortete, dass er nicht verpflichtet war, solche Fragen zu beantworten.
11) Die Papiere, die Herr Danny Bickell hielt, sofern unbestreitbare Belege, die Richard Fine selbst keinen Zugang zu, was bedeutet, dass Richard Fine unter angeblichen Betrug in Aufzeichnungen der Sheriff und dem Los Angeles Superior Court statt, und das zeigte, hattewar es nie eine gültige und wirksame rechtfertigen, Urteil, Verurteilung oder Verurteilung in seinem Falle getreten. [1]
12) Kurz gesagt - Herr Bickell war und ist die Verweigerung des Zugangs zum US Supreme Court, in einer Weise, dass eine vernünftige Person würde wahrscheinlich Schluss war zu pervertieren Gerechtigkeit im Fall zur Hand.
